Criminal Possession of a Controlled Substance in the 5th degree
    Nassau County, NY 2018
FACTS: Client was pulled over by police for a traffic violation. Police noted an odor of marijuana and asked my client to exit the vehicle. Client volunteered information to police, that he had marijuana and cocaine in the vehicle. The Nassau County District Attorney has taken a hard stance on drug possession, especially in light of the current Opioid crisis. There are often no plea bargaining options, only Drug Treatment Court. Otherwise, they are holding defendants to the charge or possibly reducing to a misdemeanor drug possession.
RESULT: In this case, I demanded the lab results after several months of not receiving them. Once lab results received, it was found that the cocaine was not felony weight. Then after several months of negotiating, I was able to get the charge reduced to a non-criminal violation disorderly conduct, keeping my client’s criminal record clean.
    Grand Larceny
    Nassau County, NY 2018
FACTS: This young lady became involved, unbeknownst to her, in a bank scam. An acquaintance asked her if she was interested in making some money. He asked her for her bank card and pin number and said he would take care of the rest. The acquaintance gave the bank card back to her several days later and told her that there was $2,500 in her account and that she should withdraw it as soon as possible. She withdrew the money and then came back a week later to check on her account. She was told by the bank that her account had been closed for a fraud investigation. She was contacted by police and surrendered after they asked her to come to the Precinct.
RESULT: The DA would only initially reduce the charge to a misdemeanor with the condition of 3 years of probation. We decided not to stop there because I knew we could do better. So I had my client gather character letters, college transcripts, community service proof as well information regarding her professional plans for the future. I took this information to a Supervisor and was eventually able to get a disorderly conduct offer, a non-criminal violation, keeping my young client’s criminal record clean.

DWI; Aggravated Unlicensed Operation in the First Degree
    Nassau County, NY 2018
FACTS: This was the client’s 3rd offense involving driving while under the influence of alcohol. He refused to take the breath test. He was also charged with felony aggravated unlicensed operation, for allegedly not paying Driver Responsibility fees on prior DWI. At trial, I was able to prove that my client was not intoxicated and did not have reason to know his license was suspended. I was able to convince the judge that the police made a bad stop and arrest of my client. This, along with video of my client performing well on the standard field sobriety tests and his refusal to take the breath test, his testimony and a mix up with the defendant’s name at DMV, was enough to show that the Prosecutor could not prove his case beyond a reasonable doubt.
RESULT: Acquittal after a Bench trial on Felony DWI and Felony Aggravated Unlicensed Operation charges

Stephanie Selloni is experienced in representing professionals charged with a first-time offense. Those professionals include nurses and other health care professionals, teachers and other certified educators, certified public accountants, lawyers and law school students, law enforcement officers and civilian employees of those agencies and members of the military.

The stakes are also higher for individuals with a concealed firearm or concealed weapons permit. When the stakes are high, make sure your criminal defense attorney is experienced in protecting you from the direct and collateral consequences of the accusation.

Experienced DWI / DWAI Defense Attorney in Nassau County, NY

Driving While Intoxicated (DWI) is a very common offense in Garden City and throughout Nassau County. People are arrested every day and night, whether driving back from the city on the Long Island Expressway or on the city streets of Uniondale or Levittown. Charges can include DWI, aggravated DWI, or DWAI.

A DWI arrest or conviction has very serious consequences. You will lose your license, pay thousands in fines and fees and, depending on the charge and the number of prior convictions, be forced to have an ignition interlock device or even spend time in jail. Just because you were arrested for drunk driving, however, does not mean you will inevitably suffer these punishments. Like any other criminal charge, a person facing DWI charges has rights, including a right to an attorney.

Whether your case involves a DWI breath test, blood test, or refusal to submit to testing, Stephanie Selloni can help. Your lawyer can challenge each piece of evidence including the BrAC or BAC test results or the alleged refusal to submit to chemical testing. Your attorney can file motions to contest the legality of the initial stop, the prolonged detention or the arrest.

Your criminal defense attorney can also negotiate with prosecutors to seek reduced the charges and the conditions of probation. Stephanie Selloni can also represent you in an administrative license suspension hearing so that you can properly protect your driver's license.

Pursuing the Most Favorable Outcomes Including a Case Dismissal

Prosecutors have a heavy burden. At trial, the prosecutor must prove every single element of their case beyond a reasonable doubt. The defense lawyer does not have to prove anything. Criminal defense attorneys do have an important job. The attorney must protect the rights of the person accused, move to suppress or exclude prejudicial evidence, negotiate the best possible resolution on a pre-trial basis, and argue for the "not guilty" verdict at trial.

Protecting the rights of the accused could involve challenging evidence illegally obtained by police in Long Island. Evidence, like the actual narcotics in a drug case, is usually discovered as the result of a search. To search anywhere a person would have a reasonable expectation of privacy, the Long Island police must have probable cause, which usually requires a warrant.

If they fail to follow strict procedures, the evidence they find as a result of that search may be inadmissible in court. Without that evidence, prosecutors may not have enough to prove a case beyond a reasonable doubt. In those cases, the prosecutor may have no choice except to reduce or dismiss the charges.
