Eligibility Requirements for Various Drug Court Programs 

The eligibility requirements for Felony Diversion Court include:

  • alcohol or drug addiction being a factor that contributed to the current charges;
  • the participant is charged with Class E, D, C, or B offenses such as unlawful possession or sale of a controlled substance;
  • the participant is 21 years of age or older;
  • the participant admits to having a drug problem and expresses a desire for treatment;
  • the participant agrees to treatment for a period of 18 months.

The eligibility requirements for Veterans Treatment Court include:

  • the pending charges must be a violation or misdemeanor charge (although some felony charges are eligible);
  • the participant has anger management problems, traumatic brain injuries, PTSD, poor coping skills, substance abuse or mental health issues; and
  • the participant has served in the military and was honorably discharged from service.

The eligibility requirements for Drug Treatment Court include: 

  • pending misdemeanor or violations only;
  • the participant has no pending felony charges;
  • alcohol or drug abuse must have been a factor in the pending charges;
  • the participant is 21 years of age;
  • the participant is facing at least 90 days in jail; and
  • the participant has at least two prior criminal convictions.

The eligibility requirements for the S.T.E.P. Program includes:

  • the participant was referred by the court following a first-time DWI charge;
  • the participant wants to enter the voluntary program;
  • the participant has no pending felony charges.
