Avoiding a Point Suspension

The New York State (NYS) Department of Motor Vehicles (DMV) monitors a point system that helps it identify drivers who commit several traffic violations during specific periods of time. If the driver accumulates a certain number of points for violations that occurred during a certain time period then the driver’s license can be suspended or revoke.

If you accumulate 11 points or more for violations that occurred during a 18 month period then you will receive notification from the DMV that your driver’s license will be automatically suspended.

If you accumulate more than 5 points (measured by whether the violations occurred within a 18 month period, regardless of when the conviction occurred) then the New York State (NYS) Department of Motor Vehicles (DMV) will impose a driver assessment fee. In addition to the driver assessment fee, other fines and surcharges will be imposed by the court. If you do not pay the assessment fee then your driver license can be suspended.

The amount that you must pay for the assessment depends on the number of points accumulated. For 6 points accumulated within the 18 month period, the assessment fee is $300 ($100 per year for 3 years). For every additional point, the assessment fee is increased by $75 ($25 per year for three years).

Avoiding a Suspension for Three of More Traffic Convictions

Accumulating a certain number of points for violations that occurred during a particular time period is not the only reason a driver’s license can be suspended or revoke. For instance, the DMV in the State of New York must revoke your driver’s license if you are convicted of three speeding violations within an 18 month period, regardless of the number of points you have accumulated.

The accumulation of convictions includes both speeding tickets and misdemeanor traffic convictions (or a combination of each). Three convictions for violations that occurred within a 18 month period will result in a suspension of your driving privileges.
